1. Acceptance of Terms & Legal Capacity

By accessing, purchasing, downloading, or using any software, services, site features, or digital content provided by Lythian ("the Service", "we", "us", or "our"), you ("User", "you") agree to be bound by these Terms of Service. If you do not agree to every provision in this document, you are strictly prohibited from using our services and must immediately cease access.

You represent that you are at least 18 years of age or possess legal parental/guardian consent to enter into these binding terms.

2. Assumption of Risk & Absolute Waiver of Liability

You expressly acknowledge that using third-party software, modifications, or tools with online games involves inherent technical, contractual, and operational risks. You voluntarily assume all risks associated with the download, installation, execution, and use of Lythian software.

To the maximum extent permitted by applicable law, Lythian, its developers, operators, administrators, affiliates, and representatives shall not be held liable under any theory of law (whether contract, tort, strict liability, or otherwise) for any direct, indirect, incidental, punitive, or consequential damages, including without limitation:

• Account bans, suspensions, blacklisting, or disciplinary measures enforced by game developers, platforms, or anti-cheat providers.
• Loss of virtual currency, in-game assets, inventory, ranking, or digital property.
• System instability, software conflicts, hardware failure, operating system crash, or data loss.
• Financial losses, loss of revenue, operational downtime, or emotional distress.

All services are provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

3. Complete Indemnification

You agree to defend, indemnify, release, and hold harmless Lythian, its operators, contractors, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys' fees and legal costs) arising out of or related to:

• Your use, misuse, or inability to use our software or platform.
• Your breach or alleged breach of these Terms of Service.
• Your violation of any third-party rights, End User License Agreements (EULA), Terms of Service, or applicable local and international laws.

4. Binding Arbitration & Mandatory Legal Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

• Informal Dispute Resolution: Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute, claim, or controversy informally by contacting Lythian administration.
• Binding Individual Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, the breach thereof, or the use of Lythian services that cannot be resolved informally shall be settled exclusively through confidential, binding individual arbitration rather than in court.
• Class Action Waiver: YOU AND LYTHIAN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.
• Waiver of Jury Trial: You explicitly waive any constitutional and statutory rights to go to court and have a trial in front of a judge or jury.

5. Strict No-Refund & Anti-Chargeback Policy

Due to the immediate delivery and immutable nature of digital keys and downloadable software, all purchases are strictly final, non-refundable, and non-transferable once access or a license key has been generated.

6. License Terms & Restrictions

Lythian grants you a limited, revocable, non-exclusive, non-transferable license to execute the provided software solely for personal, non-commercial use, subject to the following strict conditions:

• No Redistribution: You shall not leak, share, resell, rent, sublicense, or distribute any software binaries, license keys, or accounts.
• No Reverse Engineering: You shall not decompile, disassemble, reverse engineer, patch, modify, or attempt to extract source code or bypass protection measures.
• Account Termination: We reserve the right to suspend or terminate your license at any time, with or without prior notice, if we suspect unauthorized distribution, manipulation, or violation of these Terms.

7. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, invalid, or unlawful by an arbitrator or court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
